These Terms of Service ("Terms") apply to everyone who uses kamkaji.in and the online stores created on it — sellers who create stores and customers who visit them. Kamkaji is operated by Akash Traders (Sole proprietorship), [office address — add it in Owner → Settings → Company details] ("Kamkaji", "we", "us"). By using the website you agree to these Terms, our Privacy Policy and, for sellers, the Seller Agreement. If you do not agree, please do not use the website.
1. What Kamkaji is
Kamkaji is a technology platform. It lets independent shop owners ("Sellers") create an online store, list their products and receive orders and enquiries from their customers on WhatsApp. Kamkaji is an intermediary under the Information Technology Act, 2000 and the rules made under it.
Kamkaji does not sell any product, does not own or stock the products shown in stores, does not collect payment for products, and does not deliver them. When you order from a store, your contract of sale is directly with that Seller. The Seller is responsible for the product, its price, description, quality, legality, taxes, invoice, delivery, returns, refunds and warranty. Each store shows the Seller's name, contact details and policies on its "Store info & policies" page.
2. Eligibility and accounts
You must be at least 18 years old, or use the website under the supervision of a parent or legal guardian. You are responsible for keeping your password safe and for everything done from your account. Tell us immediately if you think someone else has used your account.
3. Orders, prices and estimates
- Prices, offers, stock and product details are set by the Seller. Prices are in Indian Rupees and, unless the Seller says otherwise, include applicable taxes; delivery charges, if any, are shown by the Seller.
- Placing an order or enquiry sends it to the Seller. The order is confirmed only when the Seller confirms it to you. The Seller may decline an order, for example if an item is out of stock or a price was shown wrongly.
- The "Estimate" / "Quotation" PDF is not a tax invoice. If you need a GST invoice, ask the Seller.
- Payment is made directly to the Seller (for example by UPI, bank transfer or cash on delivery) as agreed between you and the Seller.
4. Delivery, cancellation, returns and refunds
Each Seller publishes their own delivery, cancellation, return and refund terms on their store's "Store info & policies" page. Sellers must accept returns of, and refund, goods that are defective, deficient, damaged, spurious or not as described, and goods delivered late against the stated delivery schedule, as required by the Consumer Protection (E-Commerce) Rules, 2020. No cancellation charge may be imposed on you unless the Seller bears a similar charge when the Seller cancels.
5. Your responsibilities
You agree not to: give false information; place fake orders; post or upload anything listed in our Prohibited Products & Content policy; infringe anyone's intellectual property or privacy; harass or defraud anyone; try to break, overload, scrape or hack the website; or use it for any unlawful purpose.
6. Content and intellectual property
Sellers own their product photos and descriptions and give Kamkaji a non-exclusive licence to show them on the website, in catalogues, PDFs and QR posters. The Kamkaji name, logo, software and design belong to Kamkaji. If you believe content on the website infringes your rights, use our complaint form — we act on valid notices as required by law.
7. Suspension and removal
We may remove content, or suspend or close any store or account, that breaks these Terms or the law, or when required by a court or government order. We will try to tell the affected user, except where the law or safety does not allow it.
8. Disclaimer and limitation of liability
The website is provided "as is". We work to keep it secure and available but cannot promise it will always be error-free or uninterrupted. As a platform and intermediary, Kamkaji is not liable for the products, services, actions or omissions of Sellers or customers. To the extent permitted by law, our total liability to any user for any claim related to the website is limited to the plan fees that user paid us in the 3 months before the claim (or ₹1,000 for users who paid nothing). Nothing in these Terms limits any right you have under the Consumer Protection Act, 2019 that cannot be limited by contract.
9. Indemnity
If you break these Terms or the law while using the website, you agree to compensate Kamkaji for losses, claims and reasonable legal costs that result from it.
10. Complaints
For any complaint about the website, a store, a product or content, please see our Grievance Redressal page or use the complaint form. You will get a ticket number to track it.
11. Changes to these Terms
We may update these Terms from time to time. We show the date of the latest version below and inform registered users of important changes at least once a year. Using the website after a change means you accept the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of India. Subject to your rights under consumer protection law (including the right to approach a Consumer Commission), the courts at Varanasi shall have jurisdiction. We encourage you to contact us first — most issues are solved quickly.
